HUNTINGTON, W.Va. (WSAES) — The city of Huntington has filed a formal complaint against Premier Food and Beverage and the bar’s owners, a week after a man who worked inside a nearby restaurant was shot and killed.

A formal complaint was filed in Cabell County Circuit Court on Nov. 10, alleging that Premier and the owners “three times failed to manage the establishment in a manner that provided protection to patrons, citizens and guests of the bar. City of Huntington.”

According to the complaint, four people have been shot near the bar in the last eight months. The city is asking the court to declare the liquor store a public nuisance and shut it down forever.

City of Huntington Attorney Scott Damron released the following statement about the complaint:

Today, the City of Huntington filed a lawsuit against Premier Pub and Grill, the owner of the property and the limited liability company that operates the bar. The city is seeking an application from the court on the grounds that the operation of the liquor shop is a public nuisance. We are seeking this ruling because the bar and its patrons have been involved in three shootings in the last eight months, resulting in the killing of an innocent man. This does not happen with properly handled bars. We acknowledge that one of the bar owners took responsibility in a recent television news broadcast and we hope the owners do the right thing and close the bar permanently. If not, we are prepared to proceed with the closure through the public nuisance process. In parallel with the lawsuit, a motion to declare the bar a public nuisance under applicable state law is pending before the Huntington City Council. The steps taken now are consistent with Mayor Williams’ statements about the need to close the bar.

Meanwhile, the Huntington City Council’s public safety committee will meet Nov. 14 at 6:15 p.m. to consider a motion to declare the bar a public nuisance.

On Nov. 4, a shooting occurred outside Premier Bar & Grill and Joe Bryan, an employee inside DP Dow, was hit by a stray bullet and killed.

A case has been registered against two people in connection with the shooting.
