Nov. 8—JOHNSTOWN, Pa. — Cambria County Chief Judge Timothy P. Creany has ordered arguments in a legal case over plans to build a cement plant in Richland Township.
Several Richland Township officials have filed an appeal seeking to overturn an August decision by the Richland Township Zoning Hearing Board allowing the plant to be built on Mine Road 37 near the interchange with Eisenhower Blvd.
No trial or new arguments are allowed in the matter, but oral arguments will begin at 1 p.m. March 16, Creany said in an order.
The proceedings will include a court review of the fairness and validity of the board’s decision, Creany wrote.
After a series of meetings, the board in August passed some exceptions to the city’s zoning ordinance to allow Quaker Sales Corp.
The plant’s location is less than a mile from homes on Mine Road 37 and less than two miles from the University of Pittsburgh at Johnstown campus, Richland High School and Arbutus Park Retirement Community.
The new ceramics plant will replace Quaker Sales Corp.’s existing plant. in West Taylor Township with a new renovation.
The appellants are attorneys Joseph Green, Wayne Langerholc and Michael Carbonara – who live in the Mine 37 area. Their concerns about the proposed development include increased traffic, noise and pollution.
In their appeal, the plaintiffs said they believe the board’s decision was “unlawful, arbitrary, capricious, and unconscionable in its discretion, unsupported by evidence.” of records, is illegal and does not follow due process.”
