PARKERSBURG, W.Va. (WTAP) – A Wood County Grand Jury has chosen not to indict two Wood County Sheriff’s Department officers following a June 7, 2022 shooting in Waverly, West Virginia. Release from the Wood County Prosecutor’s Office.

Evidence was presented during a special session of the Wood County grand jury about the encounter and shooting involving officers Turner, Cross and Franklin Phillips at his residence in the 100 block of Waverly Street.

In September 2022, Phillips was charged with terroristic threats, obstructing an officer and five counts of assault on a law-enforcement officer.

The grand jury heard testimony and a completed report from Trooper BK Hammontry, the lead investigating officer from the West Virginia State Police. After considering all of the evidence presented, Deputies determined that Turner and Cross’ actions were justified and no criminal charges will be filed against them.
