Rudy Giuliani A new challenge was filed Wednesday in a multibillion-dollar legal battle accusing voting machine company Smartmatic of defrauding the 2020 election campaign.
In March, a Manhattan judge dismissed Smartmatic’s lawsuit against the Fox Corporation, Maria Bartiromo, Lou Dobbsand Giuliani, who successfully dismissed some of the charges against him. Jeanine Pirro a Sidney Powell managed to cancel the trial for them all.
On Wednesday, a judge agreed to revive one of the counts dismissed by Giuliani. That account said Giuliani disparaged the company by saying their “voting technology was designed and used to fix, rig and steal elections.”
“Since that defamatory statement contradicts the integrity of SUSA’s business, ‘an action for false defamation and injury is clearly alleged,'” Manhattan Supreme Court Justice David Cohen written in a seven-page law.
Smartmatic filed its $2.7 billion lawsuit in February 2021, accusing Fox of engaging in a “conspiracy, which undermined democracy worldwide and caused serious harm to Smartmatic and other stakeholders participating in new elections.”
Giuliani and Smartmatic did not immediately respond to emails requesting comment.
When the lawsuit was first filed, Fox responded that it “does its best to provide the full context of each story with in-depth reporting and clear reasoning.”
“We are proud of our 2020 election coverage and will vigorously defend this lawsuit in court,” a spokesperson said at the time.
The case is increasingly being discovered. In September, a judge ordered Fox to begin turning over millions of documents requested by Smartmatic. Smartmatic’s lawyer accused the network of delaying procedures.
“It’s about time,” Wipper thundered. “That’s the strategy here.”
Fox isn’t the only network that Smartmatic has pushed for politically. He also filed a lawsuit against One America Network and Newsmax, known for their social media coverage Donald Trump and trading the fraud claims of the former president.
For Smartmatic, the 2020 election opened up these networks to poaching Fox viewers. Its competitor Dominion interpreted their statements in separate lawsuits.
“In search of profits and viewers, OAN – a competitor to the Fox media outlet – enters a race to the bottom with Fox and other outlets like Newsmax to spread lies and create stories about election fraud. ,” Dominion said.
The idea that Smartmatic swung the vote to Trump is one of the most popular conspiracy theories about the 2020 presidential election. Its machines were only used in that election in the blue-sky district of Los Angeles in California, not in swing characteristics. Trump’s own cybersecurity czar called the race the most secure in American history.
Fox argues that it has the right to report on the arguments of the president’s lawyers. According to Smartmatic, the network realized those theories didn’t hold water and aired it without skepticism.
