More than 100 legal challenges have been filed in battleground states. They are concerned with how the votes are cast and the votes are counted. The lawsuits threaten to delay the final vote count and the certification of some results in the main contests.

For more on what this means for the midterms, I’m joined by election law expert Rick Hasen. He is the director of the Democratic Defense Program at UCLA School of Law.

Rick Hasen, thanks for coming back here.

One of the types of lawsuits that have been filed is around mail-in and absentee ballots, and when those are counted and who counts them. Can you explain what’s going on there? Who is making those claims? And what are they arguing about?

Rick Hasen, UCLA School of Law: Well, you’re right that there are a lot of lawsuits about mail-in voting, because we saw this huge increase in mail-in voting in the 2020 election because of the pandemic. epidemic.

And many governments need to step up, and there is a question of how to do it. Some of those questions have been answered. Some of them haven’t. But one of the things that happened in 2020 was Donald Trump voting by mail, which is said to be the way to cheat.

And we’ve seen Republicans file lawsuits trying to challenge some type of election or process. A major case in Pennsylvania is where a person casts a valid ballot, which arrives on time, but does not have a date on it.

So we are seeing these kinds of lawsuits. We’re also seeing voting rights advocates and Democrats arguing about the ineffectiveness of certain laws. We just decided this evening in Georgia that some voters in Cobb County, Georgia, did not receive their absentee ballots, and a judge has issued an emergency order to find out if there is a way they can vote on Election Day.
