Separately, Congress General Secretary Jairam Ramesh said the party’s stand since 2004 has been that it supports reservation in education and jobs for economically weaker sections in the entire community without disturbing the existing reservation for Scheduled Castes, Scheduled Castes and Other Backward. In a statement, Ramesh said the Supreme Court upheld the constitutionality of the 103rd amendment, which was passed by Parliament in January 2019. “All five judges upheld the 103rd Amendment Acts as it provides for reservations for the EWS category. Three judges have opined that the EWS category can exclude Scheduled Castes, Scheduled Tribes and OBCs. There are different reasons. of each person for their position,” says Ramesh.

Two judges held that exclusion of SCs, STs and OBCs from the EWS category was illegal, he said. Along with many other parties, the Congress supported the Constitution Amendment Bill in the Parliament even though a joint parliamentary committee was asked for the same for detailed scrutiny, he said. But it was forced by holding the Lok Sabha elections, he added.

Acknowledging that each of the five judges has raised several issues, Ramesh said the Congress is now studying them. Asked about differences of opinion in various states and the position of the Congress, Ramesh told reporters that as a national party, the concerns of the states should be respected and taken seriously. all and work on balance.

Recalling the Dravida Munnetra Kazhagam’s legal battle against the reservation system brought in by the central government, Tamil Nadu Chief Minister MK Stalin said the trial of the case “should be considered a crisis in century’s struggle for social justice.” The DMK’s all-party meeting passed a resolution on the 10% EWS reservation, and decided to file a review petition against the recent Supreme Court decision that upheld the quota. The Tamil Nadu government has also decided not to implement the EWS quota.
