In a statement, Ramesh said the Supreme Court upheld the constitutionality of the 103rd amendment, which was passed by Parliament in January 2019. “All five judges upheld the 103rd Amendment Acts as it provides for reservations for the EWS category. Three judges have opined that the EWS category can exclude Scheduled Castes, Scheduled Tribes and OBCs. There are different reasons. of each person for their position,” says Ramesh.
Two judges held that exclusion of SCs, STs and OBCs from the EWS category was illegal, he said. Along with many other parties, the Congress supported the Constitution Amendment Bill in the Parliament even though a joint parliamentary committee was asked for the same for detailed scrutiny, he said. Acknowledging that each of the five judges has raised several issues, Ramesh said the Congress is now studying them. Asked about differences of opinion in various states and the position of the Congress, Ramesh told reporters that as a national party, the concerns of the states should be respected and taken seriously. all and work on balance.

The Tamil Nadu government has also decided not to implement the EWS quota.
