The following statement pertains to an agent involved shooting that occurred on Sunday, October 30, 2022, near San Luis, Arizona. The following information is based on a preliminary review by the Customs and Border Protection Office of Professional Responsibility. .

On October 30, 2022, a Border Patrol remote camera operator located a group of six undocumented immigrants entering the United States approximately 1.8 miles west of the San Luis Port of Entry. The camera operator observed at least one person armed with a handgun. The camera operator radioed the information to Border Patrol agents assigned to the Border Patrol Tactical Unit operating in the area.

Tactical Unit agents encountered the group approximately 300 yards from the US/Mexico border at approximately 7:09 p.m. During the encounter, three agents fired their weapons, striking and killing one subject, later identified as the armed male citizen of Mexico. Along with the pistol found near the deceased. Agents captured four of the group and one escaped to Mexico.

The FBI, San Luis Police Department, Department of Homeland Security’s Office of Inspector General and CBP’s OPR responded to the scene.

This incident is under investigation by the FBI, San Luis Police Department and CBP’s OPR. The matter was also reported to the DHS OIG.
