The decision follows a letter from the Ministry of Home Affairs (MHA) outlining the categories of prisoners eligible for release from August 15 onwards.
The order issued by the Assam Home and Political Department said that women and homosexuals sentenced to the age of 50 years or more will be released if they complete 50% of the total sentence period excluding the remission period. gross earned. For male offenders, the minimum age for parole is 60 years.
Physically challenged offenders with 70% disability or more, duly certified by the medical board will also be released if they complete 50% of the sentence period without counting the period of general amnesty earned. There are no conditions for the release of sick prisoners except for the certification of the medical board.
Other categories of prisoners who are eligible for parole are those who have served two-thirds or 66% of their sentence, poor prisoners who have completed their sentences but are still in prison due to the payment of fines. after being exempted from fines, and juvenile offenders who have no criminal record or other charges against them.
The amnesty, however, will not apply to criminals sentenced to death, life imprisonment, criminals involved in terrorist acts and those caught under laws such as the Unlawful Activities (Prevention) Act. and the National Security Act.
Exemption from sentence is also not for prisoners convicted of dowry murder, counterfeit money, rape, human trafficking and crimes under the Child Protection Act for Sexual Offenses, prisoners convicted of money laundering, accused of treason, convicted of narcotics. and the Anti-Corruption and Psychotropic Substances Act.
Data provided by the Department of Home Affairs and Politics showed that there were no women and convicts who were transferred to the designated category while five prisoners aged 60 or over had completed at least 65% of their sentences.
In Assam prisons there are 12 prisoners who have completed 66% of their sentence, the highest being Silbanush Goria (90.6%) in Nagaon Central Jail.
