Phoenix (3TV/CBS 5) – A man faces manslaughter charges after he accidentally shot and killed his brother at a Phoenix apartment early Saturday morning.
Around 4:30 a.m. Saturday, Phoenix police responded to reports of “gunshots and a woman screaming” at an apartment complex near 44th Street and Thunderbird Road. When officers arrived, they found a man with a gunshot wound to the head. He was pronounced dead at the scene by Phoenix fire officials. Investigators learned that 35-year-old Dominic Jackson was holding a gun when he killed his brother. He was arrested by Phoenix police.
According to court documents, police interviewed a woman who was in the apartment during the shooting and said Jackson and his brother had been drinking and using drugs while looking at the new gun. Jackson, his brother and the woman went onto the balcony with the gun, court documents state. Jackson had a handgun in his lap when it fired and hit his younger brother in the head, according to court papers. Court papers say the woman told officers that Jackson and her brother were not arguing or fighting at the time of the shooting and that she believed it was an accident.
Jackson told officers during the investigation that he did not know the gun was loaded at the time. Investigators found two pistols and ammunition magazines on the living room sofa and a semiautomatic pistol on the ground near the brother’s body, court documents state. Jackson was arrested and charged with one count of murder.
